California Tax Filing: Rates, Community Property, Preparer Rule
Updated October 17, 2026
California's rate scale, and what it skips
The state's budget documents say California's personal income tax is modeled closely after federal law. It is imposed on net taxable income, which is gross income less exclusions and deductions. The rate structure is progressive, so higher income faces higher rates. A surcharge applies at very high income levels and funds behavioral health programs. The Franchise Tax Board's instructions give the current rates.
Some income that the federal return counts is not taxed by California.
- Social Security. The state's tax service center says California does not tax Social Security income from the United States.
- Unemployment benefits. They are federal income but are not taxable by California.
- Disability insurance. State Disability Insurance benefits are taxable only if paid as a substitute for unemployment insurance.
- Gifts and inheritances. California has no gift or inheritance tax.
Who files, and how the dates work
The state says you may have to file if you were in California for all or part of the year. You must file if you owe tax or your income is above the limit for your filing status. The limits are in the Franchise Tax Board's nonresident booklet. Even if you do not have to file, do it if California tax was withheld from your pay or you made estimated payments, because that is how you get a refund.
State and federal dates line up. When the due date falls on a weekend or holiday, the deadline to file and pay without penalty moves to the next business day. The extended filing date for people who ask for more time also matches the federal one. Check the state's page for this year's dates and our tax deadlines page.
The state's estimated tax payments follow the same quarterly pattern as the IRS, on Form 540-ES and Form 1040-ES. The IRS says an extension to file is not an extension to pay, so confirm California's extension rules on the Franchise Tax Board's page. Our extension guide covers the basics.

Community property in California
California is one of nine community property states, according to IRS Publication 555. The others are Arizona, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington and Wisconsin. The state's tax pages say the rules affect how married couples figure taxable income.
- On separate federal returns, each spouse reports half of all community income plus all of their own separate income.
- Each spouse completes and attaches Form 8958 to show how the figures were reached.
- The IRS notes that a joint return ordinarily gives a greater tax advantage, so compare both ways.
If you moved to or from California during the marriage, income earned while living here may follow community rules. Keep your move date.
California's rule for people who prepare returns for a fee
California has its own rule here. The California Department of Tax and Fee Administration says state law lets income tax return preparers charge fees only if they hold one of a short list of credentials. One of them is registration with the California Tax Education Council. The other listed credentials belong to other kinds of professionals. Read the agency's page at cdtfa.ca.gov and ask any preparer which credential they hold.
The same page gives three tips. Look for someone responsive, honest and available after you file. Be wary of anyone who promises a result or states fees unclearly. Remember that you are responsible for your return. A real preparer will not ask you to report false information or sign a blank return. The state does not endorse any preparer and points you to licensing bodies to verify credentials.
Moving to or from California
California's guidance for newcomers says part-year residents who moved mid-year may qualify for a credit if their income was taxed in more than one state. That credit is claimed on Schedule S. The state also points to its residency status guideline, FTB Publication 1031. Home sale gains are generally excludable, with the details in IRS Publication 523.
If you are leaving for Florida, keep your move date, your lease or sale papers, and your last California pay statements. Our California to Florida guide covers how to show your new home and what to expect on the part-year return.
Paperwork Californians forget
- Schedule CA (540). California starts from the federal return but adjusts it. This schedule lists the differences, including moving expenses.
- CalEITC. California has its own earned income tax credit. The state links to a calculator, so check even if your federal credit is small.
- Form 540-ES. Self-employed people and others with income outside withholding use it to pay estimated tax. The IRS says self-employed people generally must make federal estimated payments when they expect to owe tax. See our estimated tax guide.
- Withholding statements. If state tax was withheld, file to claim it back, even if your income is low.
Mistakes that delay a California return
- Copying federal unemployment income. It is not taxable by California.
- Counting Social Security. The state does not tax it.
- Ignoring community rules. Separate filers who skip Form 8958 invite questions.
- Missing the high-income surcharge. A large sale or bonus can trigger it.
